I testified for approximately 40 minutes at the FPPC hearing this morning.
The Commission voted 3-2 to find that City Councilman Galligan does not have
a conflict based on the facts as he laid them out and should not be
disqualified from voting with regard to the 301 Airport Boulevard project. My
take is as follows below although I will obtain the tape so that anyone who
wants to hear the proceedings can do so.

Commissioners Getman, Deaver and Makel voted in favor of Galligan and
Commissioners Scott and Swanson voted against. Commissioner Makel, who ended
up as the swing vote, said that she thought the case was close based on the
facts presented, but she was concerned that the Commission could never render
an opinion if they accepted facts introduced by third parties/the public.

Those Commissioners voting in favor of Galligan argued that any evidence of a
conflict presented by members of the public would only be relevant in an
injunctive action or enforcement action after the fact. Those Commissioners
essentially ignored my arguments and the arguments made in letters from
concerned members of the public. Those Commissioners voting against Galligan
cited the concern that the public should be able to have faith in the
process.

The decision that Galligan should not be excluded is based on the facts he
presented. If facts that he presented were incorrect, his immunity would not
hold. It is unclear what the results would be in the case where the facts he
presented were correct but therte were also other important facts which he
did not present. I presume this would require some judgement call by the FPPC
enforcement division.
