Rule 1 opposite tacks: Starboard over Port--port tack boat avoids
starboard
Rule 1 same tack: Leeward over Windward--windward boat avoids leeward.
The boat being avoided must hold his course--this gives the avoider a
chance.
This means you can't do a transition in front of another sailor whether
you've got the right of way or not.

The only time you can do such as transition is when you're calling for Room
At An Obstruction, e.g., you're about to hit the sea wall, beach, sand bar,
or a big boat. For me, on the river especially, my obstuction list includes
the no wind zone and I really hate it when someone forces me into it.

Anyway, I conclude that your pal should pay unless the sea wall was looming.

BTW, I noticed a fundamental problem at 3rd the other day. I was sailing on
the inside and taking my outside jibes in those nice rollers at the edge of
the channel, so if a sailor was coming toward me, I would wait and jibe
after he passed. The problem became that the sailor coming toward me was
staying in the channel and taking his inside jibe in those nice rollers.
 We'd both jibe and be right there, in each others' faces. So I began
waiting longer after passing someone before initiating my jibe.

The jibing sailor claimed no responsibility and was confident that
since he was the upwind sailor he had the right of way. He said that
it should've been the leeward sailors responsibility to avoid
anything that comes from windward and therefor I was at fault.
